SIMAHIR USER AGREEMENT
1. Introduction
1.1 Welcome to SiMahir ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our mobile platform, which connects individuals seeking household and personal services ("Users") with independent service providers ("Providers"). By using the SiMahir mobile app, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the platform.
2. Platform Usage
2.1 Mobile App Only: SiMahir operates exclusively through mobile applications — one for Users and one for Providers. Our website (simahir.com) is only for informational and legal reference purposes.
2.2 No User Charges: SiMahir does not charge Users any fees for using the platform. All service-related fees are paid directly to the Provider.
2.3 No Payment Facilitation: SiMahir does not process or hold payments on behalf of Providers. Users are responsible for settling payments directly with the Provider after service completion.
3. User Accounts
3.1 Registration: Users must register via the SiMahir mobile app to access services. Accurate and complete information must be provided during sign-up.
3.2 Account Security: You are responsible for maintaining the confidentiality of your login information. Unauthorized use must be reported immediately. We are not liable for any loss arising from unauthorized account access.
3.3 Verification Requirements: We may request identity verification (e.g., KTP, selfie, proof of residence) to prevent fraud and ensure trust among users.
3.4 Suspension or Termination: We reserve the right to suspend or terminate any account for violations of these Terms or suspected fraud.
4. Acceptable Use & Conduct
4.1 User Behavior: Users agree to engage with Providers respectfully and fairly. Harassment, threats, or inappropriate behavior may lead to account termination.
4.2 Prohibited Conduct: Users and Providers may not engage in:
- Impersonation or false identity.
- Offering or requesting illegal services.
- Misrepresentation of service quality or availability.
- Circumventing platform fees by conducting off-platform transactions.
4.3 Three-Strike System:
- 1st Violation: Warning issued.
- 2nd Violation: Temporary suspension, pending investigation.
- 3rd Violation: Permanent account ban and blacklist from SiMahir.
4.4 Monitoring: SiMahir uses automated and manual methods to detect suspicious activity. Accounts may be flagged and reviewed at our discretion.
5. Booking Services
5.1 Requesting Services: Users may browse and request services from available Providers through the mobile app. Service acceptance is at the Provider’s discretion.
5.2 Cancellations & No-Shows: Users should cancel in advance when possible. Repeated no-shows may result in temporary suspension.
5.3 Payment Terms: All payments are settled directly between the User and the Provider. SiMahir is not responsible for payment issues, disputes, or refunds.
6. Provider Policies
6.1 Service Listings: Providers must describe services clearly and honestly, including pricing, scope, and availability.
6.2 Compliance: Providers are responsible for ensuring their services comply with local laws and safety standards.
6.3 Service Fulfillment: Providers must honor confirmed bookings. No-shows, poor conduct, or customer complaints may result in penalties or suspension.
6.4 Prohibited Services: Listings involving illegal, unsafe, or inappropriate services are strictly prohibited.
7. User Policies
7.1 Booking Services: Users agree to pay the listed service fee and be available for the appointment as scheduled.
7.2 Cancellation & No-Shows: Users must cancel within the allowed window. Frequent no-shows may result in account warnings or suspension.
7.3 Abuse & Harassment: Any form of verbal or physical abuse toward Providers will not be tolerated.
8. Service Delivery
8.1 Provider Responsibility: Providers must arrive on time, provide services as agreed, and act professionally at all times.
8.2 User Responsibility: Users must provide accurate location details and a safe environment for service delivery.
9. Dispute Resolution
9.1 Informal Resolution: Users should first attempt to resolve issues directly with the Provider.
9.2 Reporting: Users may report Provider misconduct through the app. SiMahir may investigate and take necessary action, including suspending the Provider’s account.
9.3 Platform Limitations: As SiMahir does not mediate payments or hold funds, we are not responsible for financial disputes between Users and Providers.
10. Intellectual Property
10.1 Ownership: All content on the platform, including text, UI design, logos, and software, is owned by SiMahir or licensed to us.
10.2 User Content: By submitting feedback, reviews, or content through the app, Users grant SiMahir a royalty-free, non-exclusive right to use such content for platform operation and marketing.
11. Limitation of Liability
11.1 No Liability for Services: SiMahir is not a service provider and does not assume responsibility for the quality, safety, or legality of services rendered.
11.2 No Warranty: We do not guarantee the availability, reliability, or performance of Providers listed on the platform.
11.3 Indemnification: Users agree to indemnify and hold SiMahir harmless from any claims, damages, or disputes arising from interactions with Providers.
12. Account Termination
12.1 Termination Rights: SiMahir may terminate User accounts for breach of these Terms, fraudulent activity, or inappropriate behavior.
12.2 No Appeal Obligation: SiMahir’s decision to terminate or suspend an account is final and may not be appealed.
13. Governing Law
13.1 These Terms are governed by the laws of the Republic of Indonesia. Any legal disputes must be resolved under Indonesian jurisdiction.
14. Changes to Terms
14.1 SiMahir may update these Terms at any time. Continued use of the mobile app after updates constitutes acceptance of the revised Terms.
